Terms and Conditions for ‘Creator Summit: Powered by Fujifilm 2025’

These Terms and Conditions ("Agreement") govern your participation in the ‘Creator Summit: Powered by Fujifilm’ event, which will take place on February 22-23, 2025 at Luna Park Sydney.

By registering for or attending the event, you agree to comply with these Terms and Conditions.

1. Registration and Ticketing

1.1 Event Registration
To attend the event, you must register via the official event registration platform at https://fujifilm-houseofphotography.com.au/products/creator-summit and purchase a ticket. Tickets are available as detailed on the registration page - and will provide guests with:

  • 1x Day Admission to ‘Creator Summit: Powered by Fujifilm’.
  • 1x Goody Bag, valued at $300, to be collected in person between 9-11am on the day of your Admission.

1.2 Ticket Types and Prices
Ticket prices and categories are outlined on the event website and are subject to change. All ticket sales are final once processed and are subject to the provisions of the Australian Consumer Law regarding cancellations and refunds (see Section 4).

1.3 Ticket Transfer and Resale
Tickets - and inclusions, such as Single Ride Tickets or Goody Bags - are non-transferable and non-refundable except as outlined in Section 4. Reselling tickets for a price above the original price or transferring tickets to others may result in the cancellation of the ticket.

1.4 Consumer Guarantees
As required under Australian Consumer Law, tickets for the event come with guarantees that cannot be excluded, including that the tickets will be provided with due care and skill, and that the event will be as described. If these guarantees are not met, you may be entitled to a remedy, such as a refund or replacement (see Section 4).

2. Event Conduct

2.1 Code of Conduct
Attendees must behave respectfully, professionally, and lawfully at all times. Harassment, discriminatory behavior, or any illegal activity will not be tolerated. Event staff reserve the right to remove any attendee from the event without a refund if they engage in inappropriate conduct or violate any laws.

2.2 Personal Belongings
There are no cloaking facilities at this event, so attendees are responsible for the safety and security of their personal belongings. The event organisers are not liable for any loss, theft, or damage to personal property.

2.3 Recording and Photography
Attendees could be responsible for any damage sustained to the Venue and/or fittings during the Event and could be charged for any repairs, labour or replacement, as deemed necessary by management.

2.4 Damage to Property
By attending the event, you consent to being photographed, filmed, or recorded. Event organisers and third-party partners may use your image, voice, or likeness for promotional purposes, including but not limited to social media, advertising, and marketing materials, without compensation to you.

3. Health and Safety

3.1 Health and Safety Compliance
You agree to comply with all relevant health and safety guidelines set by the event organisers, including but not limited to any COVID-19-related protocols, social distancing, or other safety measures in place at the time of the event.

3.2 Medical Emergencies
In case of a medical emergency, please immediately notify event staff or security personnel. If you have any health conditions that could require special attention, please inform the event organisers before the event.

3.3 Injury or Accident
By attending the event, you acknowledge that you participate at your own risk and that the event organisers are not liable for any injury, accident, or loss of personal property that may occur during your attendance, except where caused by the event organiser's negligence.

4. Event Cancellation, Rescheduling, and Refunds

4.1 Event Cancellation
If the event is cancelled by the organisers due to unforeseen circumstances (such as natural disasters, force majeure events, or other uncontrollable factors), ticket holders will be notified as soon as possible. In such cases, ticket holders are entitled to a refund or the option to transfer their ticket to a rescheduled event, as determined by the organisers.

4.2 Event Rescheduling
If the event is rescheduled, ticket holders will be offered the option to attend on the new date, or a full refund can be provided. Any refunds will be processed in accordance with Australian Consumer Law.

4.3 Consumer Rights to a Remedy
Under the Australian Consumer Law, consumers are entitled to a remedy (such as a refund, replacement, or repair) if the event does not meet certain guarantees (e.g., if the event is cancelled or significantly altered, or if the event fails to meet the standard as described). You can seek a remedy through the event organisers within a reasonable time if any of these guarantees are not met.

4.4 Refund Policy
Refunds will be processed in accordance with Australian Consumer Law. Refunds may not be available in cases where you change your mind or fail to attend the event without a valid reason, as such instances are not covered under the consumer guarantees provided by Australian law.

5. Liability and Disclaimer

5.1 Limitation of Liability
To the maximum extent permitted by law, the event organisers, their employees, contractors, agents, and affiliates will not be liable for any loss, damage, injury, or death arising from your attendance at the event, except where caused by the event organisers’ negligence or a breach of statutory guarantees under Australian Consumer Law.

5.2 Indemnification
You agree to indemnify and hold harmless the event organisers, their employees, contractors, and affiliates from any claims, demands, or liabilities (including legal fees) arising out of your actions or conduct at the event.

6. Privacy and Data Protection

6.1 Collection of Personal Information
By registering for the event, you consent to the collection and use of your personal information in accordance with the event organiser's Privacy Policy. Personal information may include your name, contact details, and any other data necessary for processing your registration, ticketing, and attendance at the event.

6.2 Use of Personal Information
The event organisers may use your information to communicate event details, send marketing materials, and share information about future events. You can opt-out of marketing communications by following the instructions in the communications.

6.3 Third-Party Services
If you opt-in to any third-party services offered in relation to the event, such as sponsorships or vendor services, you agree that your personal data may be shared with those third parties in accordance with their privacy policies.

7. Force Majeure

7.1 Force Majeure
Fujifilm Australia is not liable for failure to perform any obligation under these Terms and Conditions due to events beyond the company’s reasonable control, including but not limited to storms, natural disaster, earthquakes, flood, fire, lightning, labour and/or employment disputes including strikes and lockouts or by government act or direction (a force majeure event) preventing the event from moving forward.

7.2 Postponement in Event of a Pandemic
In the event of a pandemic or Government imposed restrictions on gatherings, Fujifilm Australia will use reasonable endeavours to accommodate rescheduling however this cannot be guaranteed and the company is not liable for failure to perform.

8. Governing Law

8.1 Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

9. Changes to Terms and Conditions

9.1 Amendments
The event organisers reserve the right to amend these Terms and Conditions at any time. Any updates will be posted on the event website. Your continued participation in the event will be subject to the most recent version of these Terms and Conditions.
