TERMS AND CONDITIONS FOR HOUSE OF PHOTOGRAPHY GIFT CARDS

The House of Photography Gift Cards Program are operated by Fujifilm Australia Pty Ltd (000 064 433) (“we“, “us“ or “our“). These Terms and Conditions apply to all House of Photography Gift Cards issued by us. A reference to “you” and “your” is a reference to a Gift Card purchaser or recipient (as applicable). 

You should read these Terms and Conditions carefully.  If you are giving or sending the Gift Card to another person, you must confirm with them that you may provide their details to us prior to sending us the information, let them know these Terms and Conditions apply and ensure they know the date that the Gift Card expires.

You agree to be bound by these Terms and Conditions by purchasing a Gift Card, making any transaction using a Gift Card, or exercising or attempting to exercise any right to redeem a Gift Card.

Definitions

“Gift Card” means the digital gift card or physical gift card issued by us that you have received or purchased from the Website or HOP Retail Store.

“House of Photography Gift Card Program” means the program operated by us for the issue and redemption of Gift Cards, to which these Terms and Conditions apply.

“HOP Retail Store” means the FUJIFILM House of Photography located at 263 George Street, Sydney NSW 2000.

“Website” means fujifilm-houseofphotography.com.au.

Purchase and Use of the Gift Card

1. You may purchase a Gift Card from the Website or the HOP Retail Store. Digital gift cards will be sent as a link to the nominated email address (“Confirmation Email”). Please note physical gift cards can only be purchased at the HOP Retail Store and are subject to availability.
2. You may purchase the Gift Card in multiple denomination options, starting at $50 and a maximum value of $1000 to be loaded onto each Gift Card. The value loaded onto the Gift Card at the time of purchase is referred to as the "Initial Value" and includes GST. The Gift Card denominations will be shown on the Website. 
3. You may purchase a Gift Card as a gift or on behalf of another person. If you are sending or giving the Gift Card to another person, you must make sure that you have their consent to provide their personal information to us before providing such information. You must also make sure that you provide them with these Terms and Conditions and ensure that they know the date that the Gift Card expires.   
4. The Gift Card is not reloadable. The Gift Card is not redeemable for cash. You should treat the Gift Card as cash. The Gift Card cannot be replaced if lost or stolen. Gift Cards will not be replaced or refunded.
5. Once activated, the Gift Card can only be used for purchases on the Website or at the HOP Retail Store.
6. Following a successful transaction, the remaining value of the Gift Card (if any) will be that proportion of the Initial Value of the Gift Card which is unspent immediately prior to the transaction, less the value of the goods and services that are the subject of the transaction ("Remaining Value").
7. The Remaining Value may be used to pay in whole or in part for future purchases on the Website or at the HOP Retail Store in accordance with these Terms and Conditions.
8. You acknowledge and agree that the Initial Value and Remaining Value of the Gift Card will be reduced by the value of all subsequent purchases of goods and services that are purchased using the Gift Card on the Website or at the HOP Retail Store, whether or not made by you.
9. Upon expiry of the Gift Card, the Gift Card will no longer be redeemable and any Remaining Value that remains unspent will be forfeited, except as required by law.
10. You may check the Gift Card balance (i.e. the Initial Value and Remaining Value), the expiry date and transaction history:
• for digital gift cards, by accessing the link in the Confirmation Email. 
• for physical gift cards, by visiting the HOP Retail Store and scanning your card.

11. The Gift Card may only be used to make purchases through the Website or the HOP Retail Store for a total value up to the Initial Value. If the total purchase price of goods or services you wish to purchase exceeds the Initial Value or Remaining Value of the Gift Card, you will need to provide an additional method of payment for the additional amount.
12. The Gift Card issued to a purchaser may not be cancelled or exchanged by you for any other type of Gift Card or credit note.
13. Goods or services that are purchased using the Gift Card may be exchanged or returned in accordance with our exchange and returns policy at https://fujifilm-houseofphotography.com.au/policies/refund-policy. In the event that returned goods or services that have been purchased using the Gift Card qualify for a refund, you must provide to us the original purchase docket or transaction confirmation and Gift Card. Once the refund has been processed, the Remaining Value of the Gift Card will be increased by the amount of the refund. A refund cannot be processed to a Gift Card where it results in the Gift Card’s Remaining Value exceeding the Initial Value of the Gift Card.
14. In the event that you are unable to produce the Gift Card for the purposes of processing a refund, or the refund cannot be processed as the Remaining Value exceeds the Initial Value of the Gift Card, then we may in our discretion:
• replace the goods or re-perform the services; or
• provide you with a voucher or replacement Gift Card for the equivalent value.
15. Gift Cards may be used as personal or business gifts, but may not be used in connection with any marketing, advertising or other promotional activities.

Your responsibility

16. You are responsible for your Gift Card and are liable for all transactions made using your Gift Card.
17. We are not responsible for any failures or interruptions in the provision of point of sale facilities and Gift Card transaction functionality on the Website.

Changes to and withdrawal of the House of Photography Gift Card Program

18. We may change these Terms and Conditions at any time upon 30 days’ notice in the following circumstances:
• for administrative or operational reasons, or to prevent the occurrence of fraud or other unlawful, damaging or unacceptable conduct;
• to comply with any applicable law or regulation, or binding judgment, order, standard or determination of any court, tribunal or government or quasi-government agency or body; or
• where we reasonably consider the change will not be to the material detriment of existing valid Gift Card purchasers or recipients.
19. Notice of changes to these Terms and Conditions will be made available on the Website.
20. We may discontinue or terminate the Gift Card Program at any time upon 60 days’ notice. Notice of such discontinuance or termination will be made available on the Website. Gift Cards issued as at the date of discontinuance or termination may continue to be redeemed in accordance with these Terms and Conditions until their expiry date not withstanding any such discontinuance or termination.

General

21. These Terms and Conditions are governed by the laws of New South Wales, Australia. Any dispute arising from your receipt or use of a Gift Card is subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
